Please read these Terms and Conditions before using www.a3k.sg or engaging our services.
1. Introduction
These Terms and Conditions govern your use of http://www.a3k.sg and the warehousing, storage and logistics services provided by A3K Pte Ltd (“A3K”, “we”, “us” or “our”). By using our website or engaging our services, you (“Customer”, “you”) agree to these terms. If you do not agree, please do not use our website or services.
2. Services
We provide warehousing and storage packages, short-term and long-term storage, logistics support and customised logistics solutions. The scope, duration and fees of each service will be set out in a quotation, package description or written agreement between you and A3K.
3. Quotations and Bookings
- Quotations are based on the information you provide and are subject to confirmation.
- A booking is confirmed only when we accept it in writing, by email or by a signed agreement.
- We may revise a quotation if the actual goods, volume, duration or handling needs differ from what was originally stated.
4. Fees and Payment
- Fees are charged according to the package or quotation agreed.
- Unless stated otherwise, all prices are in Singapore Dollars and exclude GST.
- Invoices are payable within the period stated on the invoice.
- We may charge interest on overdue amounts and may suspend services or withhold release of goods until outstanding amounts are paid.
- Additional charges may apply for extra handling, extended storage, special requests or services outside the agreed scope.
5. Storage Term and Termination
- Storage may be arranged on a short-term or long-term basis as agreed.
- Either party may end the arrangement by giving reasonable written notice, as stated in your agreement or quotation.
- On termination, you must collect your goods and settle all outstanding fees by the agreed date.
- We may terminate the arrangement immediately if you breach these terms, fail to pay, or store prohibited goods.
6. Goods Accepted for Storage
You confirm that you are the owner of the goods stored, or are authorised to store them, and that the goods are lawfully obtained and described accurately to us.
7. Prohibited Goods
You must not store or move any of the following:
- Illegal, stolen or counterfeit items
- Hazardous, flammable, explosive, toxic or radioactive materials
- Weapons, ammunition and controlled items without proper authorisation
- Perishable goods or live animals, unless specifically agreed in writing
- Items that may damage other goods or the premises, or cause a safety risk
We may refuse, remove or report any goods that breach this clause, and you will be liable for any resulting loss or cost.
8. Packing and Labelling
You are responsible for ensuring that goods are properly packed, sealed and labelled before delivery to us. We are not responsible for damage caused by inadequate packing or by the nature of the goods.
9. Access to Goods
Access, collection and delivery of goods are subject to the arrangements agreed with us, including scheduled times and advance notice. We may require proof of identity or authorisation before releasing any goods.
10. Insurance
Goods are stored at the Customer’s own risk unless otherwise agreed in writing. We strongly recommend that you arrange your own insurance for your goods against loss, theft, fire, damage and other risks.
11. Limitation of Liability
- We will take reasonable care of your goods while they are in our custody.
- To the fullest extent permitted by law, A3K is not liable for loss or damage caused by events beyond our reasonable control, the nature or condition of the goods, inadequate packing, or incorrect information supplied by you.
- We are not liable for indirect or consequential loss, including loss of profit, revenue, business or opportunity.
- Where liability is established, it shall be limited to the fees paid by you for the services in the three months before the event giving rise to the claim, unless the law requires otherwise.
- Any claim for loss or damage must be notified to us in writing within a reasonable time after you become aware of it.
12. Right to Retain Goods
If you fail to pay any amount due, we may retain your goods until payment is made in full. If amounts remain unpaid after reasonable notice, we may, to the extent permitted by law, sell or dispose of the goods to recover what is owed.
13. Unclaimed Goods
If goods are not collected after the storage period ends, we will make reasonable attempts to contact you. If you do not respond within a reasonable period, we may dispose of the goods and recover any costs from you.
14. Indemnity
You agree to indemnify A3K against any claims, losses, damages and expenses arising from your breach of these terms, the storage of prohibited goods, or any claim by a third party relating to your goods.
15. Website Use
You agree to use our website lawfully and not to interfere with its operation, attempt unauthorised access, or misuse its content. All content on this website, including text, logos and images, belongs to A3K or its licensors and may not be copied or reused without our permission. Information on the website is provided for general guidance and may be updated at any time.
16. Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these terms.
17. Force Majeure
We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, fire, flood, pandemic, government action, power or system failures, strikes and transport disruptions.
18. Changes to These Terms
We may update these Terms and Conditions from time to time. The latest version will be posted on this page with the updated date. Continued use of our website or services means you accept the changes.
19. Governing Law
These terms are governed by the laws of Singapore. Any dispute arising from or in connection with them shall be subject to the exclusive jurisdiction of the courts of Singapore.
